Terms and Conditions of Use

These Terms and Conditions of Use (“Terms”) govern your access to and use of the PhotoReport service operated by OMNIA FLUIDES, SAS, 12 Rue Albert Einstein, 77420 Champs-sur-Marne, France (RCS Meaux 880 596 945) (“the Company”). By using the Service, you agree to these Terms.

1. Definitions

  • Service: the PhotoReport platform (iOS application, web dashboard, shared report viewer, marketing website).
  • User / You: any person who creates an account or uses the Service.
  • Account: the personal account created to access the Service.
  • Project: a workspace containing plans, annotations, photos, and audio comments.
  • Content: all data uploaded or created by Users within the Service.
  • Company / We / Us: OMNIA FLUIDES, as identified above.

2. Service Description

PhotoReport is a photo documentation and reporting tool for construction and engineering professionals. It allows users to create and manage projects, annotate PDF plans, attach photos, videos, and audio recordings, collaborate with team members, and generate password-protected shared reports.

3. Account Registration

Access to the Service requires creating an Account via email/password, Apple Sign-In, or Google Sign-In. You must be at least 18 years of age. You agree to provide accurate information and keep your login credentials secure. Any unauthorised use of your Account must be reported immediately to contact@photoreport.app.

4. Subscriptions and Pricing

The Service offers the following tiers:

  • Free: 1 project, unlimited plans and photos, 3 exports
  • Pro: EUR 19/month or EUR 190/year, 5 GB storage, unlimited projects
  • Teams: EUR 25/user/month or EUR 249/user/year, 20 GB per user, full collaboration

Subscriptions may be purchased through the App Store (In-App Purchase) or directly from the Company. Payment terms and renewal conditions depend on the billing channel chosen. No partial-period refunds are provided; you retain access until the end of the current billing period.

Companies wishing to subscribe to a Teams plan on behalf of their organisation are invited to contact us at contact@photoreport.app to arrange tailored contractual terms.

5. Collaboration

Project Owners on the Teams plan may invite other Users via time-limited invitation links. Two roles exist: Owner (full management rights) and Collaborator (view and contribute). The Owner retains ownership of the Project and all Content within it, and may remove a Collaborator at any time. A Collaborator may leave a Project at any time; in both cases, access is immediately revoked.

6. Shared Reports

Shared reports are password-protected and have a configurable expiration date. Expired reports are automatically deleted. The Company is not responsible for the distribution of report links or passwords by the User.

7. User-Generated Content

You retain all intellectual property rights to the Content you upload or create. By using the Service, you grant OMNIA FLUIDES a non-exclusive, worldwide, royalty-free licence to host, store, and transmit your Content solely to operate the Service. This licence terminates when you delete the Content or your Account. You agree not to upload content that is unlawful, defamatory, malicious, or that infringes third-party rights.

8. Acceptable Use

You agree to use the Service in accordance with these Terms and applicable law. You may not reverse engineer the Service, attempt unauthorised access, use automated tools to collect data, interfere with the Service’s operation, or share your credentials.

9. Intellectual Property and Confidentiality

The PhotoReport application, including its design, code, and logos, is the exclusive property of OMNIA FLUIDES and is protected by intellectual property laws.

The Company treats all User Content as confidential and will not access, use, or disclose it except as necessary to operate the Service or as required by law.

10. Service Availability

The Service is provided on an “as-is” and “as-available” basis. We may temporarily interrupt the Service for maintenance or updates. We reserve the right to modify or discontinue any part of the Service at any time. In the event of permanent discontinuation, we will provide reasonable notice and time to export your data.

11. Limitation of Liability

The Company’s total liability is limited to the fees paid by you during the 12 months preceding the event. The Company shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits or data. You are responsible for backing up your own data.

12. Account Termination

You may delete your Account at any time. Deletion permanently removes all associated data, except where retention is required by applicable law. We may suspend or terminate your Account for violation of these Terms.

13. Governing Law and Disputes

These Terms are governed by French law. For disputes between professionals, the courts of Meaux, France have exclusive jurisdiction. If you are acting as a consumer within the meaning of the French Consumer Code, you may refer disputes to a consumer mediator free of charge (details available at contact@photoreport.app). The European Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr.

14. General Provisions

If any provision of these Terms is held invalid, the remaining provisions remain in full force. The Company shall not be liable in cases of force majeure as defined under French law. These Terms constitute the entire agreement between you and the Company. We may update these Terms at any time; material changes will be notified to Users by email or through the application. The Company may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not transfer your Account without prior written consent.
